GENERAL TERMS AND CONDITIONS

Reservation and deposit

 

Deposit: to confirm your booking, a deposit of $500 AUD ($333 USD / 305 EUR) must be paid and received by us. Reservations will not be considered confirmed until the deposit is received. Cancel anytime before 3 months prior to the trip's departure dates for a full refund of your deposit. After this period, the deposit becomes non-refundable

 

Balance payment: the remaining balance must be paid no later than 30 days prior to your trip departure date. This ensures we can make all the necessary arrangements for your unforgettable experience. 

 

Cancellations & Refund Policy

 

We understand life can get busy and personal situations can change, so we like to be as flexible as possible. 

You can cancel your booking anytime before 3 months prior to the trip's departure then and you will receive a full refund. For cancellations after this period, unfortunately we can't offer refunds, but we encourage you to find someone to take your spot. In that case, will offer a full refund (including the deposit) minus $250 per customer in administration fees

On our side, we will also try to help you to find someone to cover your spot but the less notice we have, the more difficult it generally becomes to re-book the spot. We often have waiting lists but our ability to re-sell your spot is out of our control. It is under your responsibility to find a replacement in order to get the refund or date transfer to another trip. 

 

Confirmation and final payments

 

Confirmation of your booking will be sent to the email address provided by you at time of booking once we receive the deposit. 

We will send you an email reminder 35 days before the trip’s departure day with instructions on how to pay the balance payment. 

Failure to pay the full amount by the due date will result in the cancellations of your booking and the deposit paid shall be lost. 

Any payment made, including the deposit, will be forfeited unless a request to transfer to another trip departing within the same year. 

 

Date transfers

 

Any date transfer is subject to availability. The difference between the cost of the original booking and the new full-priced trip must be paid by the customer, if this is a higher amount.

Cancellation by SAMEWAVE
 

While we strive to ensure smooth operations for all our surf trips, there are instances where cancellations or rescheduling may occur.

 

We continuously monitor events that may impact the safety or execution of your upcoming trip. In the rare case of a 'major event' cancellation by SAMEWAVE due to safety or operational reasons, occurring 60 days or more before the trip begins, you will be promptly notified via email. In such instances, you will have the option to transfer your deposit to any available alternate surf trip or receive a full refund. 


Please note the following: SAMEWAVE is not liable for any costs incurred for travel arrangements beyond our surf trip booking in the event of cancellations or rescheduling. To ensure seamless planning, we recommend awaiting our trip confirmation or 60 days before your surf trip begins before finalising your travel arrangements

 

Data collection

 

Prior to the start of the trip you will be required to complete an online form with some basic information regarding your surf skills, fitness level and any food requirements we should know in advanced. 

 

Photo Release Agreement

 

A Photo Release Agreement is a document that grants SameWave and our photographers permission to use photographs or videos taken during the surf trip that may include images of you. By signing this agreement, you give us the right to use these visuals for promotional, marketing, and other related purposes. 

Upon completing your booking, you will receive an email with instructions on how to access and sign the Photo Release Agreement. This is a simple process and can be done electronically for your convenience. We respect your privacy, and your participation in photo sessions is entirely voluntary. If you choose not to sign the Photo Release Agreement or wish to discuss specific terms, please reach out to our team, and we'll be happy to address your concerns.

 

Waiver Agreement

 

A Liability Waiver Agreement is a legal document in which you acknowledge and accept potential risks associated with the surf trip and release SameWave Surf Trips from liability for any injuries or damages that may occur during the course of the adventure.

 

Upon completing your booking, you will receive an email with instructions on how to access and sign the Liability Waiver Agreement. This is a crucial step in the booking process, and we appreciate your understanding and cooperation. While surfing is an exhilarating and rewarding activity, it's important to be aware of the inherent risks involved. Our team is committed to providing a safe environment, and your adherence to safety guidelines outlined in the Liability Waiver Agreement is essential for a secure and enjoyable experience. 

 

We encourage you to carefully read and understand the terms of the Liability Waiver Agreement. If you have any questions or concerns, our team is here to provide clarification and ensure you feel comfortable with the agreement.


 

Travel insurance policy

 

We strongly recommend you purchase comprehensive travel insurance at the time you pay a deposit.

 

Airport transfers

 

Transfers between airports and to location are not included in the trip cost, unless specified. You can contact us to help you organise this. 

 

Passports and Visas 

 

It is your responsibility to ensure that you have a valid passport (valid 6 months after the departure date). You must also be in possession of visas, if necessary.

 

Minimum age

 

You must be at least eighteen (18) years of age at the time of the trip to attend.

Assignment

The SAMEWAVE COMMUNITY is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

 

Entire Agreement

 

These Terms constitute the entire agreement between SAMEWAVE COMMUNITY and you in relation to your use of this Website, and supersede all prior agreements and understandings.

 

Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the State of Australia, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Australia for the resolution of any disputes.

SAMEWAVE SURF TRIPS will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

 

Maintaining the Quality of your Personal Information
